A federal judge has ruled against New Jersey Representative LaMonica McIver’s attempt to have assault charges dismissed. The first-term Democrat is accused of assaulting federal officers during a confrontation outside a private migrant detention facility in May. U.S. District Judge Jamel Semper declined to dismiss two of the three charges against her.
Judge Rejects Key Arguments
Judge Semper, appointed by President Biden, issued a 41-page opinion on November 13th, stating that McIver’s “active participation in the alleged conduct removes her acts from the safe harbor of mere oversight.” The judge found that McIver “actively engaged in conduct unrelated to her oversight responsibilities and congressional duties,” whether lawful or unlawful.
McIver’s legal team had argued that the case was politically motivated, spearheaded by Alina Habba, a former Trump attorney now serving as New Jersey’s top federal prosecutor. They also contended that McIver is protected by the Constitution’s “speech or debate” clause, which shields lawmakers from liability for actions taken during official duties. Judge Semper rejected these claims, dismissing the argument that the jail visit qualified as protected congressional oversight and dismissing the claim of selective or vindictive prosecution by the Trump administration.
Awaiting Further Evidence on Third Charge
While two charges were not dismissed, Judge Semper deferred ruling on the third charge, pending the submission of more evidence. The indictment details allegations of physical violence, including striking and forcibly grabbing a federal agent, which are considered rare for a sitting member of Congress.
McIver expressed disappointment with the ruling, viewing it as an example of the administration targeting political opponents. “I am not in this fight only for myself, and I am concerned that this decision will simply embolden the administration,” she stated. Her attorney, Paul Fishman, indicated they are “evaluating next steps” regarding the legal decisions they believe are “wrong.”
The Path Forward
The judge’s decision means that the assault charges against Representative McIver will move forward, setting the stage for further legal proceedings. The case highlights the complex intersection of political duty, legal accountability, and the challenges faced by public officials navigating such situations.
