Letitia James: Mortgage Case is ‘Vindictive’ Prosecution

Talk about a legal showdown! New York Attorney General Letitia James is pushing back hard against the mortgage fraud case filed against her. She’s not just denying the charges; she’s calling the entire prosecution a politically motivated attack, orchestrated by President Donald Trump himself. Ouch!

Accusations of Retaliation and Name-Calling

In a motion filed with a federal judge, James’ legal team laid out a case for dismissal, citing a pattern of comments from President Trump that they argue demonstrate personal animus. This animosity, they claim, stems directly from James’ previous lawsuit against Trump and his companies in her official capacity as New York’s top lawyer.

The filing highlights Trump’s alleged history of using harsh language against James, describing her with terms like “crooked,” “scum,” “a monster,” and “criminal.” Her lawyers contend that these attacks were retaliation for her fulfilling her statutory duties and speaking out against the President.

A Pattern of Perceived Persecution?

James pleaded not guilty to the charges last month, telling reporters outside the courthouse that the Trump administration was weaponizing the justice system for “revenge.” Her defense team is also pointing to what they see as selective prosecution, suggesting that the Justice Department is scrutinizing her while overlooking similar conduct by other public officials, particularly those who are allies of the President.

The Charges and the Prosecutor

The core accusation against James involves allegedly lying on mortgage papers to secure favorable loan terms for a home she purchased in Norfolk, Virginia, where she has family. Interestingly, she was charged in Virginia by a U.S. attorney, Lindsey Halligan, who was appointed to the post by Trump and reportedly lacks prior prosecutorial experience. This appointment followed the departure of a prosecutor who had been overseeing both this case and another similar one without bringing charges.

Adding fuel to the fire, Trump himself made an extraordinary social media post urging Attorney General Pam Bondi to prosecute James and other political adversaries, emphasizing that “JUSTICE MUST BE SERVED, NOW!!!” This call came after Trump had faced multiple impeachments and indictments himself.

A History of Trump’s Ire

Letitia James, the first woman elected as New York’s Attorney General in 2018, has been a frequent target of Trump’s criticism. This is particularly true since she secured a significant judgment against him and his companies in a lawsuit alleging he defrauded banks by inflating the value of his real estate holdings. Although an appeals court later overturned the hefty fine, it upheld the finding that Trump had committed fraud.
