The legal battle for Sean ‘Diddy’ Combs continues as his team takes his case to a federal appeals court. The focus? His conviction on prostitution-related charges and, significantly, the length of his prison sentence, which judges are now questioning.
Challenging the Conviction and Sentence
Combs’ attorneys are arguing that his actions, particularly recordings of sexual encounters, should be protected under the First Amendment as a form of “amateur pornography” and “expressive activity.” They contend that the legal definition of prostitution shouldn’t encompass what they describe as consensual, staged events.
The core of their argument is that the trial court may have improperly considered allegations from charges Combs was acquitted of when determining his sentence. This, they argue, led to an unusually harsh punishment for someone with his criminal history and comparable convictions.
The Mann Act and Prosecutors’ Response
Combs, who has been in federal custody since his September 2024 arrest, is currently serving time in New Jersey. His conviction stems from the Mann Act, which prohibits transporting individuals across state lines for illegal sexual purposes. His projected release date is currently April 2028.
Federal prosecutors, however, are pushing back hard against the defense’s interpretation. They argue that labeling conduct as “creative” or “staged” doesn’t grant it constitutional protection and that accepting such reasoning could allow illegal commercial sex operations to claim free speech rights.
Concerns Over Sentencing Factors
During the oral arguments on April 9 in New York, the three-judge panel expressed concerns about whether the trial judge had overstepped by factoring in allegations tied to acquitted charges. This is a critical point for Combs’ legal team, who are seeking either a complete reversal of the conviction or a significantly reduced sentence.
The high-profile trial brought many details of Combs’ private life to light, including testimony about drug use, violence, and orchestrated sexual encounters. While he was convicted on prostitution-related charges, he was acquitted of more serious accusations like sex trafficking and racketeering, which carried potential life sentences.
