Did you bank with Capital One and hold a 360 Savings account? You might be in line for a piece of a $425 million settlement! A federal judge has given the green light to this major payout, which aims to resolve claims that the bank engaged in some pretty tricky marketing. Let’s dive into what this means for you.
What’s the Big Deal About These Savings Accounts?
The core of the lawsuit revolves around Capital One’s 360 Savings accounts. The accusation is that the bank didn’t consistently increase the interest rates on these older accounts to match the higher rates offered on their newer 360 Performance Savings accounts. On top of that, customers claim Capital One kept promoting the original 360 Savings as a great high-yield option without clearly mentioning the better-paying alternative.
Are You Eligible for a Payout?
Here’s the crucial part: if you held a Capital One 360 Savings account at any point between September 18, 2019, and June 16, 2025, you’re likely eligible. This wide window means many customers could be affected by this settlement.
How Will You Get Your Money?
If you’re eligible, Capital One will automatically send you a cash distribution. Typically, this comes as a mailed check. However, there was a deadline of March 30, 2026, to opt for an electronic payment instead. Heads up: if your share of the settlement is less than $5 and you didn’t choose electronic payment, you won’t receive a payout.
It’s also worth noting that customers had the option to exclude themselves from the settlement by that same March 30 deadline. Opting out was the only way to keep your right to sue Capital One separately over these issues. If you opted out, you won’t get any money from this settlement fund.
How Much Could You Receive?
The $425 million is the total settlement pot. From this, attorney fees (up to 15%) and administrative costs will be covered first. The rest will be divided among all eligible customers. The amount each person receives will be calculated based on the difference between what their 360 Savings account earned and what the 360 Performance Savings account was offering during the same period.
When Can You Expect the Funds?
The court granted final approval for the settlement on April 20, 2026. Barring any unexpected appeals, payments are anticipated to start going out around July 27, 2026. So, keep an eye on your mailbox or your bank account!
