Big Tech is facing a major legal challenge! The NAACP has filed a lawsuit against Elon Musk’s artificial intelligence company, xAI, and its subsidiary MZX Tech. The core of the complaint? Allegations of illegal air pollution stemming from gas turbines powering xAI’s data centers near Memphis, Tennessee, and in North Mississippi.
Allegations of Illegal Pollution
The lawsuit, filed in the U.S. District Court for the Northern District of Mississippi, specifically points to 27 gas turbines operating in Southaven, Mississippi, just south of Memphis. These turbines, reportedly installed between August and December 2025, are accused of harming residents in both North Mississippi and Memphis through harmful air pollution. This operation allegedly powers xAI’s ‘Colossus 2’ data center, which is used for its Grok chatbot.
Violations of the Clean Air Act
According to the lawsuit, xAI’s operation of these gas turbines is illegal because they allegedly lack the necessary air permits. This is seen as a direct violation of the Clean Air Act, a federal law designed to protect public health and welfare by regulating emissions of hazardous air pollutants. Earthjustice, representing the NAACP, emphasizes that no company is exempt from environmental laws.
The pollutants released by these turbines include smog-forming emissions, fine particulate matter, and hazardous chemicals. These substances are known to be linked to serious health issues such as asthma, respiratory diseases, heart problems, and even certain types of cancer. The NAACP argues that this poses a significant risk to the health of the communities involved.
Environmental Justice Concerns
Abre’ Conner, the NAACP’s director of environmental and climate justice, highlighted the broader issue of environmental injustice. “A data center should not be a potential death sentence for a community’s health,” Conner stated. The organization argues that companies like xAI are following a pattern of burdening Black and frontline communities with toxic pollution in their pursuit of ‘innovation,’ rather than prioritizing people’s well-being and the environment.
The NAACP is seeking a court order to confirm xAI’s violation of the Clean Air Act and to shut down the unpermitted turbines. They are also asking the court to mandate the installation of the best available emissions control technology and impose daily financial penalties for ongoing violations. The message is clear: communities should not be treated as sacrifice zones for Big Tech’s convenience.
