Uncle Nearest Receiver Seeks Gag Order on Fawn Weaver

In a significant development concerning the Uncle Nearest brand, the court-appointed receiver is requesting a gag order against its founders, Fawn and Keith Weaver. Receiver Phillip G. Young Jr. wants to prevent them from making public statements about the ongoing receivership, citing the chaos it has caused.

Confusion and Contradictory Statements

The request, filed on March 23, comes after Fawn Weaver announced on Instagram that “the receivership has ended” and “the reorganization has begun.” This statement was quickly followed by a press release announcing a lawsuit against their lender and claims of Chapter 11 bankruptcy protection. However, a U.S. Bankruptcy Judge blocked the filing, noting it violated previous court orders.

According to the receiver, Fawn Weaver also texted Uncle Nearest employees, spreading the same message about bankruptcy and an appeal. Young stated in his filing that these conflicting messages have resulted in “widespread confusion” among all parties involved.

Impact on Employees, Vendors, and Buyers

The “whiplash” from these contradictory filings has reportedly led to at least one distillery employee resigning. The confusion has also extended to creditors, vendors, and potential asset purchasers. The receiver noted that at least two potential buyers have paused their work due to uncertainty about the company’s ability to deliver clear title to property.

Furthermore, distributor payments have been delayed. Young emphasized the significant cost in time and money caused by Weaver’s actions since the autumn, stating, “More importantly, she has significantly damaged the brand by these actions.”

Seeking Silence and Sanctions

Previously, the receiver had sought $75,000 in monetary sanctions. Now, in addition to sanctions, he is requesting the court to “enjoin Fawn Weaver from speaking about this proceeding.” Young believes this gag order is necessary to allow him to effectively carry out his court-ordered duties and stabilize the company.
