In a verdict that’s sending shockwaves across the internet, a North Carolina jury has ordered TikTok influencer Brenay Kennard to pay a staggering $1.75 million. The judgment comes after Kennard was found liable for her role in destroying the marriage of Akira Montague and her husband, Tim Montague.
The Case of Alienation of Affection
The civil suit, filed in Durham County Court, accused Kennard, who manages Tim Montague, of seducing him and engaging in an affair. This alleged affair ultimately led to the dissolution of the Montagues’ marriage, which began in 2018. Akira’s legal team stated that the verdict represents justice for her loss of her husband and the father of her children.
The case was built on North Carolina’s unique “alienation of affection” law. This law permits a spouse to sue a third party who has interfered with their marital relationship. It’s a legal concept that’s only recognized in a handful of U.S. states, making this case particularly noteworthy.
Jury Deliberations and Kennard’s Defense
After nearly two hours of deliberation, the jury found in favor of Akira Montague. They awarded $1.5 million for alienation of affection and an additional $250,000 for “criminal conversation,” a legal term referring to the act of having sexual relations with someone else’s spouse. The jury determined that Kennard’s actions directly caused Akira mental anguish and deprived her children of a stable two-parent household.
Kennard, who represented herself in court, denied the allegations. She claimed that Akira had consented to the relationship because she believed her marriage was already over. However, Akira’s legal team presented evidence, including video clips where Kennard appeared to joke about sexual encounters and making Akira uncomfortable. Kennard insisted these remarks were taken out of context.
North Carolina’s History with Love Triangle Lawsuits
This verdict adds to North Carolina’s notable history of high-profile alienation of affection lawsuits. Previous cases include a record-breaking $30 million awarded in 2011, an NFL player facing a similar suit in 2018, and a former state senator settling for $3 million in 2021. Even singer Fantasia Barrino was involved in a lawsuit in 2010, though the outcome differed due to legal separation.
Following the verdict, Kennard expressed her belief that the ruling was unfair and accused Akira of seeking revenge and financial gain. She maintained that Tim Montague made his own choices and that their relationship began after his marriage had already deteriorated. It remains to be seen whether the 29-year-old influencer will appeal the decision.
