Days after being apprehended on a fugitive warrant near the U.S.-Mexico border, “Family Matters” star Darius McCrary is addressing the circumstances surrounding his felony arrest for alleged failure to pay child support. His representative is characterizing the situation as a “misunderstanding” and a violation of his due process.
Claims of Improper Notice and Due Process Violation
McCrary’s representative, Ann Barlow, released a statement explaining that the actor did not receive proper notification regarding court proceedings. “He did not receive the mailed notice to a PO box, miles from his residence that is not checked daily,” Barlow stated regarding a missed June court date. She added that McCrary contacted the court immediately upon learning of his missed appearance.
Barlow further asserted that McCrary’s “due process” was violated during the hearing process. The actor, who remains in a San Diego area jail without bond, is reportedly seeking new legal representation and feels he is being “railroaded” by the court system. His lawyer maintains that McCrary has a “bonding, caring, fit and loving relationship with his three minor children, including the one involved in this case.”
The Charges and Potential Consequences
According to Us Weekly, McCrary faces four felony charges in Michigan related to allegedly failing to pay child support. Prosecutors allege that as of March 31, 2024, the actor owed over $95,000 in back support. If convicted on all charges, McCrary could face up to four years in prison.
A hearing is scheduled for October 15th, where McCrary’s legal team will likely present their arguments regarding the alleged misunderstanding and procedural issues. The actor’s public statement aims to clarify his position amidst the serious legal allegations.
