Australia’s High Court has delivered a significant ruling, upholding the government’s decision to block conservative commentator Candace Owens from entering the country. The court found that the move did not infringe upon the nation’s implied freedom of political communication, effectively shutting down Owens’ appeal.
A Unanimous Decision on the ‘Character Test’
In a unanimous decision handed down on Wednesday, the High Court confirmed that Home Affairs Minister Tony Burke acted lawfully when he refused Owens a visa for her planned speaking tour. Burke had based his decision on Owens’ history of “conspiracy theories and anti-Semitic rhetoric,” stating that she failed to meet the Migration Act’s crucial “character test.”
Owens had taken the case to court, arguing that the “character test” was either invalid or had been improperly applied. Her legal team contended that the test was being used as a tool to silence individuals with controversial political viewpoints. Attorney Perry Herzfeld, representing Owens, argued that using “inciting discord” as a reason for visa rejection was overly broad and subjective.
Minister Welcomes Ruling: ‘A Win for Social Cohesion’
However, the High Court ultimately disagreed with Owens’ arguments. The justices concluded that “reading the minister’s decision fairly and as a whole, the minister did not misconstrue [the act] in deciding to refuse to grant the visa.” Following the ruling, Minister Burke expressed his approval, calling it “a win for social cohesion.”
Burke further elaborated, stating, “Inciting discord might be the way some people make money, but it’s not welcome in Australia.” He has previously accused Owens of making inflammatory comments targeting various communities, including Muslim, Black, Jewish, and LGBTQIA+ groups, which he believes generate controversy and hatred. The court’s decision reinforces the government’s stance on maintaining national harmony by excluding individuals deemed to pose a risk to social cohesion.
