Dr. Malcolm Tanner, an Indiana resident, announced plans in 2023 to establish a settlement for Black Americans in Loving County, Texas, promising free homes, financial stipends, and political influence. However, his vision has drawn the attention of state officials, who have issued a Temporary Restraining Order (TRO) against him, alleging he is “attempting to overthrow the government.”
Legal Challenges and Health Code Violations
Tanner, founder of Melanated People of Power, purchased 5 acres of land in Loving County, an area with fewer than 100 residents. Currently, the site consists of RVs, tents, and generators, with no permanent homes established. Texas Attorney General Ken Paxton sought the TRO, citing that the encampment violates state health codes due to the “lack of sewer access, septic systems, running water, and limited electricity.”
In response, Tanner posted a message on TikTok, asserting the righteousness of his endeavors and claiming the land is being unjustly taken. “I came to Loving County with a simple vision: to build homes, to build community, and to live under the rights that faith grants and the Constitution protects,” he stated. He expressed his belief in lawful land use and the right for families to live in peace and safety, lamenting that their efforts were destroyed and attacked.
Accusations of Political Takeover and Voter Irregularities
Adding to the scrutiny, state politicians Senator Kevin Sparks and Rep. Brooks Landgraf sent an open letter on October 3rd urging the Texas Attorney General and Secretary of State to investigate alleged voter irregularities in Loving County. This followed multiple residents of Tanner’s “melanated community” registering to vote using a common P.O. Box associated with the property.
Attorney General Paxton further accused Tanner of orchestrating a “disgustingly fraudulent plot to line his own pockets” through a deceptive scheme to lure people with free housing for a political takeover. Tanner, however, continues to encourage his followers on social media to “join the movement” and reject rent payments, framing his initiative as self-empowerment and self-determined placemaking.
Tanner’s Defense and Continued Advocacy
In a TikTok video, Tanner stated his respect for the court’s authority and his intention to comply with its orders. However, he also emphasized the broader principles at stake: “It is not simply about one man or one family, or even about one piece of land. It is about whether the rights promised to us as Americans are real — or whether they can be trampled by intimidation, harassment, and fear.” He vowed to rebuild and persevere, framing the struggle as one for freedom and justice for all Americans, regardless of race, faith, or economic status.
Tanner is meticulously preserving evidence of destruction, trespass, and intimidation, intending to present it to the court. His message is one of standing firm for liberty, asserting that “freedom in America is not granted by men, but strengthened by faith and secured by the Constitution.”
